By accessing or using the MetabolixPH website (metabolixph.com) and services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

MetabolixPH is a telehealth platform that connects patients with licensed Philippine physicians for the purpose of obtaining prescription weight loss medications and other therapeutic peptides. Our services include:

  • Health assessment questionnaires
  • Physician review and consultation
  • Prescription services (where medically appropriate)
  • Medication fulfillment and delivery
  • Educational content about treatments

Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Be a resident of the Philippines
  • Have the legal capacity to enter into binding agreements
  • Provide accurate and complete information
  • Not have any contraindications to the medications prescribed

Telehealth Limitations

Our telehealth services have limitations compared to in-person medical care. By using our services, you acknowledge that:

  • Physical examination is not possible through telehealth
  • Diagnosis relies on information you provide, which must be accurate
  • Some conditions may require in-person evaluation
  • Emergency situations require immediate in-person medical care

Prescription Medications

The medications we provide require a prescription and physician review. Our physicians may:

  • Decline to prescribe if treatment is not medically appropriate
  • Request additional information before prescribing
  • Recommend alternative treatments
  • Refer you to in-person care if necessary

User Responsibilities

Accurate Information

You agree to provide accurate, current, and complete information during registration, the health assessment, and throughout your use of our services. Providing false or misleading health information may result in:

  • Inappropriate treatment recommendations
  • Serious health risks
  • Termination of your account
  • Legal consequences

Proper Use of Medications

You agree to:

  • Use medications only as prescribed
  • Follow dosing instructions carefully
  • Report any adverse reactions promptly
  • Not share or sell medications to others
  • Store medications properly as directed
  • Dispose of unused medications safely

Account Security

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

Orders and Payments

Pricing

All prices are displayed in Philippine Pesos (PHP). Prices include medication, physician review, supplies, and standard shipping unless otherwise noted. We reserve the right to change prices at any time.

Payment

Payment is processed through PayMongo. We accept GCash, credit/debit cards, bank transfers, and cash on delivery (COD). Full payment is required before order processing, except for COD orders.

Order Fulfillment

Orders are subject to physician approval. We reserve the right to:

  • Cancel orders if physician review determines treatment is inappropriate
  • Request additional information before processing
  • Refuse service for any reason

If an order is cancelled due to medical unsuitability, you will receive a full refund.

Shipping

We ship to addresses within the Philippines. Delivery times are estimates and not guaranteed. Risk of loss transfers to you upon delivery to the carrier.

Refunds and Returns

Refund Policy

Due to the nature of prescription medications:

  • Refunds are provided if your order is cancelled before shipment
  • Refunds are provided if physician review determines you are not eligible
  • Refunds are NOT provided for medications that have been shipped and delivered
  • Damaged or incorrect orders will be replaced or refunded

No Returns

For safety reasons, we cannot accept returns of prescription medications once they have been delivered. Please verify your order details carefully before completing your purchase.

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of MetabolixPH or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express permission.

Prohibited Activities

You agree not to:

  • Provide false or misleading information
  • Use our services for any illegal purpose
  • Attempt to obtain medications for others
  • Interfere with the proper functioning of our website
  • Attempt to access other users' accounts or information
  • Use automated systems to access our website
  • Circumvent any security measures
  • Resell or redistribute our products

Limitation of Liability

To the maximum extent permitted by law, MetabolixPH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use or inability to use our services
  • Any errors or omissions in our content
  • Unauthorized access to your information
  • Any third-party conduct on our platform

Our total liability shall not exceed the amount you paid for the specific product or service giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless MetabolixPH, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, your violation of these terms, or your violation of any rights of third parties.

Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of the Philippines.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of our services after changes constitutes acceptance of the new terms.

Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and MetabolixPH regarding your use of our services.
